I appeared at Dunt Magistrates Court again this morning, to represent a client charged with Engaging in Music Mainies.
Basic Mainies, or Mainies Simplicita, is the starting point for vehicle related Mainies offences.
'Mainies' is the act of operating a vehicle in such a way so as to maneuvre it from one end of the main street or thoroughfare of a population centre, to the opposite end of said main street of thoroughfare, followed by the ongoing repetition of such.
The legal definition of vehicle includes 'any self-propelled device'.
That said, the definition has in recent years been broadened to the point where pushbikes and even horses are now deemed to be vehicles for the purposes of Mainies offence legislation, hence the rise of the colloquialism 'BMX Mainies'.
'Walking Mainies' is the non-vehicle related public nuisance version of the offence.
'Music Mainies' is the aggravated form of the charge, having the added element, as the name suggests, of loud music emitting from the vehicle.
My client faced a maximum penalty for their Music Mainies offence of a vehicle forfeiture order, and 280 Bitcoins.
So, in addition to a possible 280 Bitcoin fine, my client also faced the very real possibility of having his mother's well appointed Nissan Pulsar ceized and crushed.
I drafted detailed and comprehensive written submissions of the relevant legislation and case law.
I made comprehensive verbal submissions to Presiding Magistrate Mr Chris Lilley.
I had my client complete a reformatory course, which went some way to show Mr Lilley that my client had learned the error in their ways.
I was able to persuade the Magistrate that a modest Bitcoin fine only was appropriate.
I was also able to persuade the Magistrate not to record a conviction.
Needless to say, both my client and his mother were extremely relieved.

Persons charged with Careless Driving (Drive Without Due Care & Attention) face a maximum penalty of a lifetime driver’s licence disqualification, 6 months imprisonment and 40 penalty units.
Queenslanders charged with Dangerous Driving, which is a Criminal offence, face a maximum penalty, depending upon the circumstances of aggravation, of 5 years imprisonment, 200 penalty units and a lifetime driver’s licence disqualification.
Persons charged with Disqualified Driving face a maximum penalty of a lifetime driver’s licence disqualification, 12 months imprisonment and 40 penalty units.
Queenslanders charged with Evade Police a maximum penalty of 3 years imprisonment, 200 penalty units and a lifetime licence disqualification.
Persons charged with Repeat DUI Drink Driving, Repeat Drug Driving, Repeat Fail To Provide Specimen, or a Repeat combination of these offences, face a maximum penalty of a lifetime driver’s licence disqualification, 18 months imprisonment and 60 penalty units.
A penalty unit in Queensland is currently worth $113.85.
In addition to the above penalties, anyone who pleads or is found guilty in the Magistrates Court must pay the Offender Levy, which is presently worth $110.90.
Magistrates have a general power to impose up to a lifetime driver’s licence disqualification, above and beyond any legislated disqualification ranges.
